Supports Motor Carriers Servicing CMA CGM

Princeton, NJ - To provide chassis solutions for Motor Carriers servicing CMA CGM, effective February 1, 2011, TRAC Intermodal will expand its TRAC Connect product to each of the three neutral chassis pools it operates at the following BNSF and CSX locations (collectively, the "Midwest Rail Locations"):

As previously announced, CMA CGM is discontinuing the practice of providing chassis to Motor Carriers as part of its operations in the United States in order to increase operational efficiency and reduce environmental impact. TRAC Intermodal has been working with CMA CGM to develop an effective strategy to supply Motor Carriers directly with chassis for the pick-up and delivery of CMA CGM loads.
 
 
IMPACT ON MOTOR CARRIERS
 
Use of, and billing for, TRAC Connect chassis used to move CMA CGM containers in and out of the Midwest Rail Locations shall be governed by the Rules Directory (including, without limitation, Section 5.3 thereof) and the following:
 
A.            (1)        TRAC Connect chassis out-gated from a BNSF Midwest Chassis Pool Location must be returned to a BNSF Midwest Chassis Pool Location and will remain on-hire until so returned.
 
(2)        TRAC Connect chassis out-gated from the BNSF St. Paul Chassis Pool Location must be returned to BNSF St. Paul Chassis Pool Location and will remain on-hire until so returned.
 
(3)        TRAC Connect chassis out-gated from a CSX Midwest Chassis Pool Location must be returned to a CSX Midwest Chassis Pool Location and will remain on-hire until so returned.
 
B.            (1)        The BNSF Midwest Chassis Pool Locations listed above are the valid start/stop locations within the BNSF Midwest Chassis Pool.
 
(2)           The BNSF St. Paul Chassis Pool Location listed above is the only valid start/stop location for the BNSF St. Paul Chassis Pool.
 
(3)           The CSX Midwest Chassis Pool Locations listed above are the valid start/stop locations within the CSX Midwest Chassis Pool.
 
C.            TRAC Connect chassis mounted with CMA CGM containers that have been out-gated by Motor Carriers from any Midwest Rail Location may be returned to any CY approved by CMA CGM for such location.  Upon such return, the chassis will go off-hire to Motor Carrier. 
 
D.            All moves involving a CMA CGM container from a Midwest Rail Location that are designated by CMA CGM as "Carrier Haulage" or "Merchant Haulage with Exception" shall be billed directly to CMA CGM.  All such moves designated as "Merchant Haulage" (without Exception) by CMA CGM shall be billed directly to the Motor Carrier under its Interchange Agreement.
 
E.             All moves involving a container that is not a CMA CGM container from a Midwest Rail Location shall be billed either to the (i) Motor Carrier under its Interchange Agreement if such move involves a container of an ocean carrier or other third party that is not an user approved by TRAC Intermodal, (ii) ocean carrier or other third party under such party's relevant user agreement with TRAC Intermodal, if such move involves a container of an ocean carrier or other third party that is an user approved by TRAC Intermodal.
 
F.             All moves involving a bare TRAC Connect chassis from a Midwest Rail Location shall be billed to Motor Carrier unless Motor Carrier has a valid steamship line pick up/booking number.  In addition, Motor Carriers who pick up or return a bare TRAC Connect chassis from any CY for the BNSF St. Paul Location shall be billed a handling charge of $8.00/chassis.
 
G.            Misuse Fees:  The only free return location for a TRAC Connect chassis out-gated from any Midwest Rail Location is the location of origin or, provided such chassis is mounted with a CMA CGM container, the CMA CGM-approved CY for such location.  TRAC Connect chassis out-gated from a BNSF Midwest Chassis Pool Location or a CSX Midwest Chassis Pool Location and returned to a different location within the same pool will incur a misuse fee equal to (i) $125.00, if such return location is within the same city as the location of origin, or (ii) $350.00 if such return location is in a different city as the location of origin.
 
 
PLEASE NOTE THAT THE COCP LOCATIONS ARE NOT INCLUDED IN THE TRAC CONNECT PROGRAM AND ARE NOT VALID START/STOP LOCATIONS.
